Probate
is the legal process where the court assists in
distributing your assets.It involves a
number of legal requirements and steps to distribute
an estate. Probate is the ONLY legal way to change
the title of an asset when the person listed as the
owner cannot sign his or her name (incapacitated or dead).
Your family and friends CANNOT just sign for you. ONLY the
court can change titles after someone dies.
 What is
so bad about probate? Several Things:
1. It is expensive (may be as much as 3-8% of a person's estate)
2. It takes a lot of time (may be as much as 9 months to 2 years)
3. It is public. Others may be able to find out what you had and where it went
4. Creates problems leaving assets to minors, such as your children or grandchildren.
